Terms & Conditions
By accepting delivery of a dumpster from Hendersonville Haulers (“the Company”), (“the Customer”) agrees to comply with the following Terms and Conditions.
1. Dumpster Rental and Use
a) Authorization
Customer confirms that they are the property owner, an authorized representative of the property owner, or have permission to request dumpster placement at the delivery location.
b) Non-Transferable Rental
The dumpster rental agreement is non-transferable. Customer may not lease, loan, or allow another party to use the dumpster without written approval from the Company.
c) Responsibility for Equipment
Once delivered, the dumpster remains under the Customer’s care until collected by the Company. Customer is responsible for protecting the equipment from damage, theft, misuse, or unauthorized relocation.
d) Rental Charges
Rental fees are based on pricing provided at the time of booking. The rental period begins on the date of delivery unless otherwise agreed upon in writing.
e) Acceptable Waste
Customer agrees not to place hazardous, toxic, flammable, radioactive, or otherwise prohibited materials in the dumpster. The Company acts solely as the transporter of waste and does not assume ownership of the contents.
f) Delivery Location
The customer is responsible for ensuring that the delivery area is suitable and accessible for dumpster placement. Hendersonville Hauler is not responsible for damage to driveways, sidewalks, landscaping, underground utilities, irrigation systems, or other property resulting from delivery or pickup.
g) Rental Extensions
If additional rental time is required, the Customer must contact the Company before the scheduled pickup date. Additional rental charges may apply.
h) Access for Pickup
The customer must ensure unobstructed access to the dumpster on the scheduled pickup date. If pickup cannot be completed due to blocked access or other customer-related issues, additional trip charges may apply.
i) Weight Restrictions
Each dumpster includes a specified weight allowance. Excess weight may result in additional disposal fees based on landfill charges and overage rates.
j) Overfilled Dumpsters
Materials may not extend above the top edge of the dumpster. The dumpster must be safe for transportation and capable of being covered by the truck’s tarp system. Additional fees may apply if contents must be removed or adjusted before transport.
2. Waste Material Restrictions
a) Ownership of Contents
Customer remains responsible for all materials placed inside the dumpster until the contents are accepted by the designated disposal facility.
b) Prohibited Materials
The following materials are prohibited unless specifically approved by the Company:
- Hazardous chemicals
- Paints and solvents
- Asbestos-containing materials
- Batteries
- Tires
- Propane tanks
- Fuel containers
- Medical waste
- Explosives
- Radioactive materials
- Liquid waste
- Automotive fluids
- Electronic waste is prohibited by law
Customer is responsible for complying with all local, state, and federal waste disposal regulations.
c) Liability for Prohibited Materials
Customer accepts full responsibility for any costs, fines, penalties, cleanup expenses, environmental claims, or legal fees resulting from the disposal of prohibited materials.
d) Heavy Materials
Concrete, dirt, brick, rock, asphalt, roofing shingles, and similar heavy materials may require special approval and may be subject to additional restrictions or fees.
e) Pickup Requirements
Dumpster doors must be securely closed, and all debris must remain within the container. Dumpsters that are unsafe for transportation may require corrective action at the Customer’s expense.
f) Additional Disposal Charges
Any landfill surcharges, contamination fees, overage fees, or special handling charges assessed due to the contents of the dumpster shall be the responsibility of the Customer.
3. Payment Terms
a) Payment Authorization
A valid payment method may be required to reserve a dumpster rental.
b) Additional Charges
Customer authorizes Hendersonville Hauler to charge the payment method on file for any additional fees incurred during the rental period.
c) Outstanding Balances
Invoices not paid within the specified payment period may be subject to late fees and collection efforts where permitted by law.
4. Permits and Compliance
a) Permits
Customer is responsible for obtaining any permits, permissions, or approvals required for dumpster placement on public streets, rights-of-way, or other regulated locations.
b) Regulatory Compliance
Customer agrees to comply with all applicable local, state, and federal regulations relating to dumpster use and waste disposal.
5. Indemnification
Customer agrees to defend, indemnify, and hold harmless Hendersonville Hauler, its employees, contractors, and affiliates from any claims, damages, losses, liabilities, costs, or expenses arising from Customer’s use of the dumpster, violation of these Terms, or improper disposal of waste materials.
6. Entire Agreement
These Terms and Conditions constitute the entire agreement between the Customer and Hendersonville Hauler regarding dumpster rental services and supersede any prior discussions or agreements.
7. Modifications
Hendersonville Hauler reserves the right to modify these Terms and Conditions at any time. Updated versions will be posted on the Company’s website.
8. Governing Law
These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the State of North Carolina.
9. Severability
If any provision of these Terms and Conditions is determined to be unenforceable, the remaining provisions shall remain in full force and effect.
10. Waiver
Failure by the Company to enforce any provision of these Terms shall not constitute a waiver of its right to enforce that provision in the future.
11. Notices
Any notices required under these Terms shall be provided in writing and delivered by mail, email, or other reasonable communication methods to the contact information provided by either party.
